New Jersey Ed Data Cooperative Contract

It removes the bid. Because the contract was competitively solicited and awarded through Educational Data Services, any New Jersey district that is a registered member of the cooperative can purchase from it directly under N.J.S.A. 40A:11-11(5), without running its own procurement. That turns a process that normally takes months into a purchase order and a task order.

It covers building automation work across the range: preventative maintenance agreements, system upgrades and retrofits, controller and network replacement, integration of existing systems, graphics and programming, and emergency service. Districts can use it for a single rooftop unit or a full campus conversion.

This is an indefinite delivery, indefinite quantity contract issued under P.L. 2025 c.180 (S3041), and the compliance terms are strict by design.

All work is firm fixed price, lump sum. Time and materials billing is prohibited under N.J.S.A. 52:34-6.2 and the S3041 compliance addendum. Labor is priced at the New Jersey Department of Labor prevailing wage rate, base plus fringe, multiplied by AME’s awarded contract labor markup. Materials are priced at RSMeans bare cost multiplied by the local City Cost Index plus AME’s awarded material markup, and anything off catalog is priced at wholesale supplier cost substantiated by three written supplier quotes.

No technician mobilizes before a valid purchase order and task order have been issued through the Ed Data IDIQ portal. Work performed outside the system is not billable.

As public works, all of it is subject to N.J.S.A. 34:11-56.25 et seq. AME and any subcontractor submit certified payroll electronically to the New Jersey Wage Hub within ten days of each wage payment, and notify the district within five business days of submission.

Emergency response carries a two hour and four hour service level. Emergency calls verbally authorized by a Business Administrator are limited to the minimum work necessary for stabilization, with a written incident report within 24 hours and a formal firm fixed price estimate within five business days. Permanent repairs are raised as a separate task order.
